Beverly zoning plan opposed hands down

With about a dozen in favor and dozens against, the fate of a plan to rezone a portion of Beverly Hills is uncertain. Nearly 200 people attended Tuesday's village council meeting held at Groves High School's Little Theater to accommodate the large crowd and, by a show of hands, the residents in favor of the rezoning were far outnumbered by those opposed.

On the table was a first reading of proposed ordinance amendments to the residential zoning in areas of the village between Southfield Road, Greenfield, 13 Mile and 14 Mile to bring them into conformance with zoning regulations. "This topic goes back to at least 2004," Village Council President Todd Stearn said. "We've culminated at this point."

Brian Borden, planning consultant for the village, outlined the issue. Most of the houses in that area of the village that are non-conforming date back to the 1940s and 1950s, he said. Although they were in compliance with the zoning ordinances when they were built, amendments to the ordinances have put them into the non-conforming category. As a result, when people wanted to enlarge their houses over the years, the have applied for - and usually received - variances from the village zoning board of appeals.

"Approving variances goes against the intent of the ordinances," Borden said. Yet the village does encourage homeowners to modernize their properties, although that can violate the zoning ordinances. To resolve the conflict, the village is considering allowing some smaller setbacks along the sides of some houses and creating a new zoning district, "RB2," which would allow a minimum side setback of five feet.

"By going to five feet, it would still provide a 10-foot separation between properties," Borden said.

Stearn made a point of noting the amendments would not change any residential properties to commercial and do not impact front and back yard setbacks, which could deter placing bigger houses on smaller lots.

That didn't satisfy some skeptics. Resident Larry Needham related a series of concerns.

"The real reason (for rezoning) is to increase housing density so it will increase tax revenue," he said. "This is all about more density." He also said the reduced setbacks between houses could pose a safety hazard if there were a fire and firefighters had to maneuver in the narrower spaces.

"The houses have been out of conformance for 50 years," he said. "What harm has it done?"

Over the years, many village residents have resisted change in the mainly residential community. A few years ago, the town was divided over the issue of installing sidewalks.

Council Abuses Speakers, Administration Shortcomings, Fiscal Waste

Dreadful Utility Eyesore on Lahser Road

Utility company leaves eyesore for all to see.

HISTORY: On 2-15-05 (2 and a half years ago) the Village held a Public Hearing for a request by Consumers Energy to expand their Gas Pumping Station on Lasher Road.

As part of the approval process, Consumers agreed to enhance and improve the aesthetics of the site. They agreed to install a natural berm, plant groupings of trees and shrubs with a mixture of canopy and evergreens plus installing fencing that together would eliminate the industrial setting and provide a natural blending with surroundings.

Permission was granted by village council. Consumers expanded the pumping station but did NOT install the promised aesthetics improvements.

VILLAGE ADMINISTRATIONS LACK OF DILIGENCE: Village administration has not monitored the failure of consumers to keep its commitments. Villager’s inquiries and complaints have been ignored. This demonstrates a lack of concern and failure to follow project through to completion. This is a direct reflection of management.

QUESTIONS TO ASK YOURSELF Why is administration not doing it’s job? Does Consumers have undue influence on village administration? Is this lack of diligence and concern do to the fact 98% of village workers do not live in the village?

WHAT CAN YOU DO? You must complain to council to protect the character, beauty, and values of villager’s homes.

This eyesore is detrimental to the properties on Lasher Road and the village as a whole being on one of the main gateway roads entering our village.

There is no excuse for village administration not holding Consumers accountable in complying with their agreement.
